I am supposed to close on Wednesday, might not happen and I am livid

I will find out tomorrow if my closing will be postponed.  It is suppose to be Wednesday and all along my LO kept saying we are ahead of schedule.  On last Thursday he informed me due to I think HO6 USDA policy I have to prove insurance for inside the condo before they will clear the loan to close.  Why didn't he know this sooner?  I went with someone he recommended and then I found out I have to pay to policy in full.  I paid it in full on Friday morning and the last think my LO said is he will not know 100% if we will close when I want until tomorrow.   Mind you I set up the walk through for Tuesday, already have the change of address for Wednesday and also having the utilities turned on that day.  I planned to move on Thursday and have the movers ready.  I had to ask for time off from work ahead of time and it will be hard to get time off if I have to go into next week.  Also my father arranged his busy schedule so he can help move Thursday.  I also made arrangments for Time Warner to come Friday morning and my computer guy in the afternoon.  I also have an appointment with a new accountant.  All of these have to be changed if I don't close on Wednesday.    Sorry this has turned out to be a rant.  I am also very sick and I had to drive to my LO's office to sign the papers for the insurance with a 102 temperature just before a snowstorm hit.  I will keep you all posted to what happens.   This is suppose to be a happy time.  Just hope it turns out that way.   I have really liked my LO.  I will be very upset if I can't close Wednesday.  I signed the contract on December 12th and he kept saying we are so far ahead of schedule.  I kept asking him if there was anything else I should do and he kept saying no.  Message Edited by weathergirl77 on 02-28-2010 06:31 PM

Buyer is walking 1 week before closing – :-( Options?

Thought we were actually going to make it.  A week ago friday I found out that due to the verbage on the appraisal ("working farm") the USDA loan program wasn't going to work out for us to purchase our farm.  Scramble time!!  Friday early afternoon I got a call and thought I had our problems solved as the current mortgage WAS assumable!  SQUEE!!   then the other shoe dropped.   Saturday evening as we were getting ready to go see Wicked (HIGHLY recommend, btw!), my agent calls me with bad news.  At a week from the contract closing date, our buyer has decided she found a FSBO she likes better and is planning to walk away from our sale.  I can't buy the farm without selling my house first (both mortgages = too high DTI).  I'm utterly devestated because this is my dream farm we're talking about and now I may lose it if I can't find another buyer quick enough.  House has been on the market since mid September, we've had exactly *1* showing which was this "buyer".  That was in early november.  We had to wait while she worked on her credit - house remained on teh market.  Listing was marked as "sale pending" around Jan 20th when the actual contracts were signed.  We were still waiting for her credit to clear up and thus didn't schedule inspections until into february.  They (loan officers) were working hard with her to clear up her credit -- it wasn't a matter of IF she qualified but a matter of WHEN.  When a medical collection popped up on the radar at the pull on February 1st, there were more delays as she quickly paid off more CCs and they waited for the credit bureaus to respond so they could do another pull.  Closing would have to be pushed back but we hadn't officially changed it yet and were looking at maybe 2 weeks.  The contingency on her contract was that she must qualify for financing.  Technically, as of this weekend, she hadn't... because they hadn't gotten the paperwork back from the bureau so they could DO another pull.  I'm not a lawyer but I'm thinking that doesn't count.  Loan officer was sure she'd get the loan.   In addition to be heartbroken over the possibility that I've lost this farm, I'm absolutely livid!  Yes, I should get her earnest $$ ($500), but I'm consulting a lawyer and have definite plans to sue her for any/all of the following: the cost of the inspection for the farm ($495) - if we end up losing the farm the cost of the appraisal for the farm ($372) - if we end up losing the farm the cost of the storage unit I had to secure because when we moved the closing date to Feb 26th, she changed her mind from 1 week occupancy to at closing and I agreed meaning I'd be homeless for a week ($320) the difference in sales price when I finally do sell it the cost of mortgage payments between now and when it does sell and although it's probably a pipe dream, I'd love to make her pay for what I'm losing since I took money out of my 401K (on a loan) to pay for ALL closing costs for this transaction.  Yes, it was my decision (therefore the idea it might be a pipe dream to go after her for it) but I bent over backwards to accommodate her and this thougth is the result of feeling taken advantage of and flat out screwed by this girl.   I can hold a grudge - my best friend nicknamed me "Pitbull" several years ago.  I hate feeling this way and I do hate resorting to a lawsuit, but again... feeling used, screwed, taken advantage of, angry, frustrated, depressed and again heartbroken that this may cost me this farm.   Thanks for listening.  Anyone looking for a cute, reasonably priced, well maintained 2 bedroom house outside Dayton, Ohio? Thought deal would be dead then surprise, surprise

Wanted to share this. I had recently posted on this forum about our excitemnt of getting our offer on a home accepted. Recent events about financing delays and meeting a certain deadline on the contract were about to throw us off guard and added to a frustration about the buying process. My wife and I even came to a plan to just drop the whole thing off (there is a way out of the contract without them getting my earnest money anyways) because of delays by the loan officer at US Bank in getting a fully approved loan to meet the certain deadline before I am to suppsoeldy lose my earnest money.    Realtor calls me this Friday evening and suggests I call this person who is a broker. Call broker Friday night who gives me name of loan officer at Wells Fargo after broker asks how much money is in my savings account and asks what job do I do. Loan office calls me up Saturday evening and I tell him upfront that I need a fully approved loan ASAP but was not willing to put up with a lot of delays and vagueness about the process since we were ready to give up buying a house on the other hand. He tells me he is actually an underwriter and he proceeds to get info from me, later tells me he needs my old credit report (Dec 2009 pulled score) since I also told him I didn't want my score pulled again. Meet him today Monday in his office as agreed and I lock in a rate of 5.25% (no orig fees, $500 underwriting fee, $400+ appraisal fee) fixed for 30 years.......the previous loan application (which is still in process) was at 5.75% 5/1 ARM (no orig fees). Both loans are no prepayment penalties. This person I meet today congratulates me, saying he can get it approved tomorrow or the next next day. Whew....   I guess things turn out good in a way you didn't intend to happen, lol.

Closed 2/3 with Judgment and Foreclosure

Yesterday, I closed on a 4500 sq ft home for $139k from HUD.  I give God the Praise, myFICO, and a good loan officer.  One bank, Regions Mortgage, pre-approved me in Sept.  I made a contract on a HUD house in Nov.  After the first lender had my contract for 2 months, I was denied.  Immediately, I contacted to another bank, Wells Fargo.  I was approved in 7 days after going through the Exception Dept, first due to a Charge Off that is owned by Wachovia (Wells Fargo merged with Wachovia). Also, I had 1 unpaid judgement that I am in payments since Sept. 2009.  I had a foreclosure in Nov. 2006.    With all this, my rate is 5.25%, 30 year fixed FHA!!  It took me 6 months to get a house but it happened!! I did not have to pay the Charge Off before/after closing but now I am going to pay them since they made good on my loan.  I was told what helped the process a lot was that I knew my credit file and how to obtain information needed within minutes.  I gave this forum praise for this because before working on my credit a couple of years ago, I did not know much about the process.   To those of you that have given up, DON'T.  Know your credit file front and back and don't be afraid to let the lender know upfront what has been happening in your life.  If you have any questions, let me know.   BTW, I started with NACA when I was in another state.  I did not like the process and back and forth.  I came out of my pocket for closing $4600 because I overbid on the house by $4099 and had to pay the difference.  If I had not overbid, it would have been $500.  But it is worth it!!!   Peace!
